This SceneBot.com Privacy Policy (the "Privacy Policy") describes the practices that SceneBot, Inc. (referred to hereinafter as "SceneBot" or "we") follows with respect to the collection, use, maintenance and disclosure of information collected through the website at www.Scenebot.com (the "Website") and/or the SceneBot mobile app (the "App"). This Privacy Policy applies only to information we collect from the Website and App, and does not apply to any other website or business activity of SceneBot. By using our Website and/or App, you consent to the collection, use, maintenance and disclosure of this information by us.

We reserve the right to revise this policy at any time. When we do, we will give you notice of the revised Privacy Policy by posting the revised Privacy Policy on the Website and App and by revising the "effective date" at the top of this Privacy Policy. You are responsible for regularly reviewing the current privacy policy.

What types of information do you collect?

We collect "personally identifiable information", "usage information" and "user generated video content" (e.g., video-recorded auditions and other videos and materials that showcase acting ability and/or other talents).

"Personally identifiable information" is information that tells us who you are, such as your name, the last four digits of your social security number, physical address, and e-mail address. "Usage information" is information automatically collected by our web server (which may be hosted by a third-party) that your web browser makes available whenever you visit or use our Website or App, such as your computer's IP address or browser type. "User generated content" is content submitted in the form of electronically recorded auditions and/or other videos and materials that showcase acting ability and/or other talents; user generated video content is, in some instances, treated as personally identifiable information.

Why do you collect such information?

We may collect personally identifiable information when you create an account with our Website and/or App, verify your identity and provide consent to create a child's account, create an actor profile, edit or update your account information or actor profile, submit questions or comments via the Website and/or App, or if you voluntarily choose to provide it to us. For example, if you register with the Website or App, we may collect your email address along with a unique username and password. If you decide to create an actor profile, we may collect your first and last name, physical address, e-mail address, phone number and other information about you and your appearance (e.g., gender, birthday, hair/eye color, height, weight, skills, acting experience, training, and representation). This information is consistent with industry resume information for actors.

In order to comply with the Children's Online Privacy Protection Act (COPPA), we require that a parent or legal guardian register users under the age of 13 who would like to create an account. During the process of creating the child account, we may provide different methods for verifiable parental consent. For example, we may use an online verification service through a third party provider approved by the FTC (Federal Trade Commission). If a parent/guardian chooses this method, we will collect the following information from the parent/guardian: name, address, phone number, date of birth, and the last 4 digits of his/her social security number. Other information may also be requested during this verification process. Another method to verify parental consent is to purchase our upgraded account (currently called a "PRO Account") using a credit card. The parent/guardian who creates a child account for his/her child will have full access to that child account until it is deleted.

We may collect user generated content when you record and submit a video and/or other related content to us. In the event that the user generated content contains the name, image or other personal information of a child under the age of 13, it will be treated as personally identifiable information.

You can choose not to provide personally identifiable information to us. However, if you do not provide certain information, you may be unable to create an account, complete an actor profile or submit user generated content, so your ability to use the Website and/or App may be limited. For example, if you do not provide your gender, birthday, hair/eye color, height, and weight you will be unable to create an actor profile.

We may collect usage information anytime you view and/or interact with our Website or App or their pages, features and functionality. For example, we may collect your IP address, browser type, operating system version, and information regarding your browsing activities (e.g., information about the website that you visit before or after visiting the Website) and geographic location.

This Website and App may also use "cookies" and other technologies to recognize users, customize their experience or serve advertisements. A cookie is a small text file that a website's server places on a user's computer, mobile phone or other device. The cookie transmits information back to the website's server about the browsing activities of the user on the site. This includes information such as pages and content viewed, the time and duration of visits and whether a computer user clicked on an advertisement. Cookies also can be used to recognize users and maintain data related to a particular individual, including passwords. In some contexts, such as where a number of separate websites participate in a network, cookies can be used to track a user across different sites. Cookies are used as a standard practice by many sites. If you would prefer not to accept cookies from our Website or App or any other website, you can modify the settings on your web browser. You may refer to your browser's online help feature or user manual for instructions on how to do this. If you refuse to accept cookies, it is possible that some portions of the Website or App may not function as intended.

How do you respond to "do not track" signals?

We do not respond to "do not track" signals.

Will my or my child's information be publicly available?

If you or your child create an actor profile and/or submit user generated content to us, certain personally identifiable information may be posted on the Website and App for other registered users to view. For example, if your or your child's user generated content is selected by SceneBot, it will be posted to the Website and App for other registered users of the Website and App to view, along with your or your child's first name, last name initial, and city/state. Actor profiles will always be available to SceneBot, Inc. (including its officers and employees). If you are under the age of 13, your actor profile will also be available to your parent or legal guardian.

If your or your child’s user generated content is chosen to be shown on the Website and App, and/or you have upgraded to a PRO Account, your and your child’s actor profile (including the photograph(s) associated with that profile) may also be available to casting directors, agents, and talent managers (including those listed on our “who’s who” page), and those individuals/entities may share your or your child’s actor profile with other casting directors, agents, and talent managers. The disclosure of such information to these individuals/entities is consistent with industry standard practice for actors seeking representation as a professional actor. For users under the age of 13, all inquiries regarding the child for the purpose of an audition or representation will be directed to the contact information provided by the parent/guardian during registration.

We may also disclose certain personally identifiable information on the Website and App for registered users to view when sharing success stories about SceneBot users. This will also only display your or your child's first name, last name initial, and city/state. Except as provided in this Privacy Policy, no contact information will be available to others via the Website or App.

How else do you disclose and use information collected via the Website and App?

We may use personally identifiable information for the purpose for which it is provided and for the other purposes described in this Privacy Policy. This includes customer account creation, customer support services, and other back office activities of SceneBot.

We may also use certain personally identifiable information and user generated content for marketing purposes and in our other communications. For example, we may use certain personally photographs and names of individuals when sending communications regarding the Website or App and/or otherwise providing information about features and functionality of the Website or App.

We may disclose certain aggregate information (e.g., aggregate gender, age, and region (city/state) information) to third party advertisers or sponsors. We may also share information with third parties who provide services to us or on our behalf. For example, third parties who host the Website/App may have access to your personally identifiable information.

For parents and guardians who are registering with the Website/App in order to create a child account, we may disclose certain personally identifiable information (e.g., name, address, phone number, date of birth and the last four digits of your social security number) to a third party service provider to verify your identity.

We use usage information to help us run and maintain our Website and App, customize the visitor's experience, study traffic patterns, and generally learn about the usage of the Website and App.

We may use and disclose personally identifiable information and usage information when we have reason to believe that using and/or disclosing this information is necessary to investigate, identify, contact, or take action against someone who may have engaged in illegal activities or breached our Terms of Use or who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users of our Website or App, or anyone else who could be harmed by such activities. We may also disclose personally identifiable information when we reasonably believe that the law requires it.

We might sell or buy subsidiaries, or business units. In such transactions, personally identifiable information generally is one of the transferred business assets. Also, in the event that our assets are sold, personally identifiable information may be one of the transferred assets.

What if I don't want you to make any further collection or use of my child's information?

If you are a parent/guardian and do not want us to make any further collection or use of your child's personally identifiable information, you can delete your child's account. If you delete your child's account, we will delete your child's personally identifiable information from our records and will not make any further use of such information.

You may take either action via the User Account screen.

How can I review information that you collect about me and/or my child?

If you would like to review and/or request changes to any of your or your child's personally identifiable information collected through the Website or App, you may log in to your account with your user name and password and make any necessary changes to your account or your child's account.

Is the Website and App secure?

Information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant or guarantee the security or integrity of such information. We will not be responsible for disclosure of any information due to errors in transmission or the unauthorized acts of third parties.

You help to maintain the security of your personally identifiable information stored in our systems by keeping your username and password confidential and protecting against unauthorized access to your password and to your computer. Please use a strong password to protect against unauthorized access to your account. Be sure to sign off when finished using a shared computer.

Do you link to other websites?

While you are using this Website and App, you may be linked or directed to third party sites outside of the Website and App that are beyond our control. Each of these third party sites may have a privacy policy different from ours. For example, you might click on a link or banner ad that will take you off the Website or App. These links and banners may take you to sites of advertisers, sponsors and co-branding partners. Please review the privacy policies of these sites. We are not responsible for any actions or policies of such third parties.
